1. User Content

Diouane applications (“the App”) allow you to use the content and services we provide. You retain all ownership rights to any content you submit or create while using our Services. However, by submitting any content through our Services, you grant us a worldwide, non-exclusive, transferable, royalty-free license to use, display, and distribute such content in connection with providing the Services.

2. Copyright Infringement

Diouane respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to our designated Copyright Agent. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the information specified in Section 4 below.

4. DMCA Notice Requirements

For your notice to be effective under the DMCA, it must include all of the following elements:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing or to be the subject of the infringing activity and that is to be removed, with information reasonably sufficient to permit us to locate the material.
  • Sufficient contact information, including your mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material at issue is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.

5. Response to DMCA Notice

Upon receipt of a valid DMCA notice, we reserve the right to take any action we deem appropriate, including removing the allegedly infringing content from our Services. If the content is removed, we will make reasonable efforts to notify the user who posted the content about the removal.

If you believe your content was wrongfully removed, you may submit a counter-notification to our Copyright Agent at legal@diouane.com, including your signature, identification of the content, and a statement under penalty of perjury that you have a good faith belief that the content was removed by mistake.

6. Repeat Infringers

It is our policy, in appropriate circumstances and at our sole discretion, to disable and/or terminate the accounts of users who are deemed to be repeat infringers. A user will be deemed a repeat infringer if we receive two or more DMCA takedown notices regarding that user.
